Is it necessary to register a foreign award like a
domestic award under the Registration Act, 1908?
No, a foreign award does not need to be registered under the
Registration Act, 1908. The Arbitration and Conciliation Act, 1996, does not
require such registration. According to Section 48 of the 1996 Act, the
enforcement of a foreign award cannot be refused just because it is not
registered. Also, in the case Harendra H. Mehta
v. Mukesh H. Mehta (1999), the Supreme Court confirmed that foreign awards
under the Foreign Awards (Recognition and Enforcement) Act, 1961, do not need
to be registered.
No, a foreign award does not need to be stamped under the Indian Stamp
Act, 1899. This issue was clearly settled by the Supreme Court in M/s. Shriram EPC Ltd. v. Rioglass Solar SA
(2018). The Court held that the term "award" under Schedule I, Item
12 of the Stamp Act applies only to domestic awards under Part I of the
Arbitration and Conciliation Act, 1996. It does not apply to foreign awards.
Therefore, the requirement of stamping is only for domestic awards and does not
extend to foreign awards.
